Terms of Service
Accepting these terms
By playing Swervle, creating an account, or adding the Swervle bot to a Discord server, you agree to these terms. If you do not agree, please do not use the service.
Who can play
Swervle is intended for players aged 13 and over. If you are under 13, please do not create an account, submit a run, or connect Discord.
The service
Swervle is a free daily time-trial game. One map is published each day and every player races the same map. You can race without an account; an account is optional and only needed to claim a public identity and carry results across devices.
Swervle is provided as-is and may change. Maps, features, leaderboards, and the Discord bot may be added, altered, paused, or withdrawn at any time. We do not guarantee uninterrupted availability, and a day's map or board may be unavailable during maintenance or an incident.
Your account and public identity
Your Swervle display name is the only thing about you that appears publicly on a leaderboard, a share card, or a Discord message. Your email address and internal identifiers are never public.
You are responsible for activity under your account and for keeping access to your sign-in method secure. Do not share an account or impersonate another player.
Fair play
Every leaderboard time is verified on the server from the run's recorded inputs. The server's verdict is authoritative; a result produced anywhere else does not count. You agree not to:
- Submit a time you did not drive, or a run produced by automation rather than play.
- Modify, instrument, or replay-inject the game client to alter a result.
- Interfere with verification, submission, or another player's session.
- Attack, overload, or attempt to gain unauthorized access to the service or its infrastructure.
- Scrape or republish the service in bulk, or resell access to it.
We may remove a result, reset a display name, or suspend an account when a run or a name breaks these rules.
Display names, vehicle paint, and conduct
Swervle is a 13+ game. Display names and vehicle paint, including any text, images, or symbols, must be appropriate for players aged 13 and over.
- No sexual content, nudity, or sexual references.
- No hateful content, slurs, or hate symbols.
- No harassment, threats, graphic gore, or other content inappropriate for a 13+ audience.
- No deceptive content or impersonation of another person.
These rules apply even if content passes an automated filter. Players can report inappropriate names and paint for moderator review. We may reset a display name, remove or replace paint, or suspend an account that breaks these rules.
Runs, replays, and content you submit
When you submit a run you keep whatever rights you have in it, and you grant Swervle permission to store it and to use it to operate the service — to verify the time, publish it on the relevant leaderboards, generate share and challenge links and their preview cards, and review it for integrity and game quality. This permission lasts as long as we retain the run under the retention and deletion rules in the Privacy & Data notice.
Using the Discord bot
Connecting Discord is optional, and so is adding the bot to a server. If you add the bot to a Discord server you control, you confirm you are permitted to do so under that server's rules and Discord's own terms.
- The bot posts the daily map, live standings, and results into the channel a server administrator selects.
- A server's own leaderboard lists only players who have connected Discord and who share that server. Connecting Discord is what makes you eligible; disconnecting removes you.
- Direct messages are off by default and can be turned off again at any time in your Swervle account settings.
- Server administrators are responsible for where the bot posts and for their own members' conduct.
- We may remove the bot from a server, or pause its posting, if it is misused or if posting causes a problem for the service.
Swervle is not affiliated with or endorsed by Discord.
Leaderboards and results
A daily board stays open: a verified run enters its day's board whenever it is raced. We may correct, recompute, or remove a result when it is wrong, cannot be verified, or was produced in breach of these terms. Where a change to the game means older runs can no longer be re-verified, affected results may be retired.
Coins and the shop
Coins are Swervle's in-game currency. You spend them in the shop on paint, decals, accessories, bundles, and vehicles.
You earn coins by racing the daily: your first finish of the day, a streak, a finish in a new hour, a personal best, a climb up the board, and your rank when the day closes. On swervle.com you can also earn coins by watching an ad. You can buy coins with real money. On the web, $2 buys 1,000 coins, $5 buys 2,750, and $10 buys 6,000. In an app, the store shows the price.
- Coins are not money. They have no cash value.
- Coins cannot be cashed out or moved to another account.
- You may not sell or trade coins, items, or accounts outside Swervle.
- Shop items are cosmetic. They change how a car looks, not how it drives. Everyone races the same physics.
- Coins and items give you a licence to use them in Swervle. You do not own them outside the game.
Payments and refunds
The store you pay through handles your payment: Stripe on the web, or the app store in an app. Bought coins are non-refundable, except where the law requires a refund.
If you were charged and the coins did not arrive, or you were charged twice, email help@swervle.com with your display name and the store's receipt.
If a payment is refunded or disputed, we take back the coins it bought, up to your current balance. We may also take back coins or items gained through fraud, a bug, or a payment that was reversed.
Creators
Players approved by Swervle staff can make items and sell them in the shop.
- Staff review every listing, and every change to one, before it goes on sale.
- A creator earns 60% of each sale's price in coins. A bundle's share is split with the makers of its parts.
- Creators pay fees in coins to list and restock items.
- Creator earnings are coins, under the same rules as any other coins.
- You must have the right to everything you upload. Items follow the same 13+ rules as display names and vehicle paint.
- When you list an item, you let Swervle show it and sell it in the shop, and show it on cars in races, replays, and share cards.
We may return, edit, or remove a listing when it breaks these terms. We may end a creator's approval.
Changes to the shop
We may change prices, coin packages, how many coins racing pays, fees, the creator share, and what is for sale at any time.
If your account is suspended for breaking these terms, or you delete it, you lose its coins and items. They are not refunded. If we close the shop or end Swervle, we will give reasonable notice on this site. Unused coins are not refunded, except where the law requires it.
Ending your use
You can stop playing at any time and can request deletion of your account and associated data as described in the Privacy & Data notice. We may suspend or end access to the service for a player who breaks these terms, or where required to protect the service or other players.
No warranty
Swervle is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any result, time, or ranking will be preserved indefinitely.
Limitation of liability
To the maximum extent permitted by law, Swervle and its operator are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, results, rankings, or goodwill, arising out of or relating to your use of the service. Nothing in these terms limits liability that cannot be limited under applicable law.
Changes to these terms
We may update these terms as the game changes. The current version always lives at this address, and the date below reflects the last change. Continuing to play after a change means you accept the updated terms.
